Terms of Service

1. What the Service does

Words Abide lets you record messages (text and audio), choose recipients, and set up a Keepsake with a check-in schedule. While you keep checking in, your messages stay private. If you stop checking in for the window you configure, and only then, the Service attempts to deliver your messages to the recipients you chose. You control your messages, recipients, and Keepsakes, and you can change or delete them at any time before a release.

2. Not a will, and not legal or professional advice

Words Abide is a way to share personal messages. It is not a will, trust, or estate-planning instrument, and it is not legal, financial, medical, or professional advice. Messages delivered through the Service are not legally binding and do not transfer property, grant authority, or create legal obligations. For anything with legal effect, consult a qualified professional. Do not rely on the Service as your only means of communicating time-sensitive or critical instructions.

3. Eligibility and your account

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account information, to keep your login credentials secure, and to be responsible for activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

4. Your responsibilities

• Keep your check-ins current. The Service acts on the schedule you set; missing your check-ins is what triggers a release.
• Keep your recipient details accurate, and make sure you have a basis to share their contact information with us and to send them your messages.
• You are responsible for the content of your messages and for using the Service lawfully and respectfully.
• Maintain your own copies of anything important. The Service is not a backup or archival service.

5. Acceptable use

You agree not to use the Service to:

• create, store, or deliver content that is unlawful, harassing, threatening, defamatory, or that infringes the rights of others;
• harm, deceive, or harass any person, including your recipients;
• violate the rights or privacy of any third party, or send messages you are not authorized to send;
• attempt to breach, disrupt, probe, or reverse-engineer the Service or its security, or to access it through unauthorized means.

We may suspend or remove content or accounts that violate these Terms or that we reasonably believe create legal risk or harm.

6. Your content and license

You keep all rights to the messages and recordings you create ("Your Content"). To operate the Service, you grant us a limited license to store, process, transmit, and deliver Your Content solely to provide the Service to you and to deliver it to the recipients you choose. We do not claim ownership of Your Content and do not use it for advertising.

7. Subscriptions and payments

Some features require a paid subscription. Payments are processed by our payment provider (Stripe); by subscribing, you authorize the applicable charges, including recurring charges until you cancel. You can cancel at any time from your account settings or by contacting us; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. If your subscription lapses, some features may become unavailable; we will not use a lapse in payment as a reason to release your messages.

8. Availability and delivery

We work hard to make the Service reliable, but we provide it on an "as available" basis and cannot guarantee that it will always be uninterrupted, timely, secure, or error-free. Message delivery depends on factors outside our control, including recipient contact details being valid and reachable, third-party email, SMS, and push providers, and recipients' own systems. You acknowledge that we do not guarantee that any particular message will be delivered, viewed, or delivered at a particular time.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing would create risk to the Service or others. When an account is closed, scheduled messages will no longer be delivered, and we will handle your data as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT MESSAGES WILL BE DELIVERED, RECEIVED, OR VIEWED.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECHNO WIZARDRY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS ARISING FROM A MESSAGE NOT BEING DELIVERED, BEING DELIVERED LATE, OR BEING DELIVERED IN ERROR, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Techno Wizardry from claims and expenses arising out of your content, your use of the Service, or your violation of these Terms or the rights of others.

13. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we make material changes to the Terms, we will update the effective date above and, where appropriate, notify you. Your continued use after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Boulder, Colorado, United States for any dispute not subject to other agreed resolution.
